CONTRACTING OF AIR TICKETS

CHARGES OF MANAGEMENT AND EMISSION
The expenses corresponding to the management and emission of air tickets are not refundable in any case and are independent from the rate chosen by the Agency. MUNDO CROWN TOURS RESPONSIBILITY

CONDITIONS OF THE CONTRACT

- Terms of the contract to bearing in mind:

PRICE

The price of the combined Trip includes:
- Transfer in/out, as long as remain reflected this way in the program.
- The housing and food regime that appears in the contract or in the documentation that submits to the client in the moment to sign it. - The rates or taxes of the hotels and the indirect taxes: I.V.A., I.G.I.C, etc., when they are applicable. - Assistance for our personnel during the trip, as long as remains reflected this way in the program.
- Any other service or product that turns out to be detailed in the program or contracted trip.

Review of prices:
The price of the trip has been established on the basis of the types of change, rates of transport, cost of the fuel and rates and applicable taxes in the issue date of the program. Any variation of the price of the above mentioned elements will be able to give place to the review of the final price of the trip, both to the rise and to the fall, these modifications will be notified to the consumer. In no case, it will be checked to the rise in 20 days previous to the date of exit of the trip, respect of already realized requests.

Exclusions:
The price of the combined trip does not include: Visas, rates of airport, and / or rates of entry and exit, certificates of vaccination, personal expenses, you give for drink or any other service not specified in the program. CANCELLATION OF THE TRIP FOR NOT REACHING THE NUMBER OF PERSONS INSCRIBED IN THE FORESEEN MINIMUM

The client can cancel the contracted services, making the return of the amounts he had paid, both the total price and the advance, but must compensate the Agency for the following items:
- Management expenses and cancellation fees, if any.
- A penalty of 10% of the total trip if the cancellation occurs more than ten days and less than fifteen days before the start date of the trip; 20% between days 3 and 10, and 25% within forty-eight hours before departure.
They will be taken as causes of force majeure, which will leave the client free of any payment, death, serious illness or accident of the user, spouse, children, parents or siblings.
In case of not showing up at the scheduled time of departure, you will not be entitled to a refund of the amount paid.
In cases where the trip is conditioned to a certain number of passengers and does not reach the required number, the customer will be entitled to reimbursement of the total price or amounts advanced as a reservation, without being able to claim compensation amount. , being necessary the notification to the client on the part of the Agency with a minimum of ten days before the anticipated date of departure.

 

ALTERATIONS

MUNDO CROWN TOURS undertakes to provide all the contracted services specified in the program:
- In the event that, before departure, the organizer is obliged to modify any essential element of the contract, including the price, he must immediately inform the consumer.
- In such a case, the consumer may choose to end the contract without any penalty or accept the modification and its impact on the price. The client must communicate the decision he makes within three days after being notified of the variation referred to in the previous section. In the event that the consumer does not notify his decision, it will be understood that he opts for the termination of the contract without any penalty.
- In the event that the consumer chooses to cancel the trip, the customer will be entitled to reimbursement of all amounts paid, or to the completion of another combined trip of equivalent or greater amount, provided that the Organizer can propose it. In the event that the offered trip is of inferior quality, the Organizer must reimburse the client, when applicable, depending on the amounts already paid, the price difference, according to the contract.
- In the above cases, the Organizer will be responsible for payment to the consumer of the corresponding compensation for breach of the contract, which will be 5% of the total price of the contracted trip, if the aforementioned breach occurs between two months and fifteen days immediately prior to the planned date of completion of the trip; 10% if it occurs between the fifteen days and three days before, and 25% in the event that the aforementioned noncompliance occurs in the previous forty-eight hours.
- There will be no obligation to compensate in the following cases:
- When the cancellation is due to the fact that the number of people registered for the combined trip is less than the required
- When the cancellation of the trip, is due to reasons of force majeure,
- In no case, everything not included in the contract will be the responsibility of the Organizer, there being no obligation to compensate.
- If the transfers from the hotel-airport or vice versa, included in the offer, are not met, the amount of the alternative transportation used by the client will be reimbursed, upon presentation of the corresponding receipt or invoice.

 

OBLIGATION OF THE CONSUMER GIVES TO COMMUNICATE ANY BREACH IN THE ENFORCEMENT OF THE AGREEMENT

The consumer is forced to communicate any breach in the enforcement of the agreement in writing or in any other form in which there should still have witness, the organizer or to the retailer and, in his case, to the lender of the service about which it treats itself. In case the adopted solutions are not satisfactory for the client, this one will have the term of one month to protest before the Agency. PRESCRIPTION OF SHARES

General
The Organizers of combined trips will be liable for the damages suffered by the client as a consequence of the non-execution or poor execution of the contract. This responsibility will not occur when one of the following circumstances occurs:
- That the defects observed are attributable to the customer.
- That said defects are attributable to a third party and have an unpredictable or insurmountable nature.
- That the aforementioned defects are due to reasons of force majeure,
- That the defects are due to an event that the Organizer could not foresee or overcome.

Limits for compensation of damage
As regards non-bodily damages, these must always be accredited by the consumer. In no case shall the Agency be responsible for the expenses of accommodation, maintenance, transportation and others that are caused by force majeure. When the trip is made by coaches, limousines and similar and an accident occurs, whatever the country where it occurs, the consumer must submit a claim against the carrier in the respective country.

 

DELIMITATION OF COMBINED TRAVEL SERVICES

Travel by plane
Presentation at the airport with a minimum of 60 minutes in advance in the case of domestic flights and 150 minutes in the case of international flights over the departure time, and in any case strictly follow the specific recommendations indicated in the documentation of the trip provided when signing the contract.

 

HOTELS

General
The quality of the services provided by the hotel will be determined by the official tourist category, assigned by the competent body of your country.
It is established only the existence of single and double rooms allowing in some of the latter a third bed can be enabled, it will be estimated whenever the use of the third bed is made with the knowledge and consent of the people occupying the room.
The usual schedule for the entrance and exit in the hotels is based on the first and last service that the user will use. As a general rule, the rooms can be used from 2 pm on the day of arrival and must be vacated before 12 noon on the day of departure.
When the contracted service does not include the guidance accompaniment and in the event that the user foresees their arrival at the hotel at times other than those indicated, it is advisable to communicate this circumstance to the Agency or the hotel.
Also, if you bring pets, it is essential to notify the Agency at the time of making the reservation.

 

OTHER SERVICES

On flights whose arrival at the destination point is after 12:00 hours, the first service of the hotel, provided it is indicated in the program, will be dinner. PASSPORTS, VISAS AND DOCUMENTATION

All passengers (including children), must carry their personal and family documentation, whether passport or D.N.I., according to the laws of the country or countries visited. In case of being rejected by any Authority the granting of visas, for particular reasons of the user, or being denied entry to the country due to lack of the requirements that are demanded, or by defect in the required documentation, or because of not being a carrier of the same, the Agency declines all responsibility, being at the client's expense any expense that may arise. Clients, with a nationality other than Spanish, must ensure that they have complied with all the applicable rules and requirements regarding visas. LUGGAGE

ACCEPTANCE OF CONDITIONS

At the time of registration, the Agency may require an advance payment that in no case will be greater than 40% of the total amount of the service (unless said service has different cancellation clauses or dates in which it does not allow cancellation - in this case 100% will be requested, not having a refund in case of cancellation), issuing the corresponding receipt specifying, in addition to the amount advanced by the consumer, the reserved concept.
If the total price of the trip is not paid in the aforementioned conditions, it will be understood that the consumer desists from the trip, applying the trip cancellation clauses.
The purchase of any product will be considered effective at the moment when MUNDO CROWN TOURS receives proof of income made to the bank account, and until that moment the reservation may be canceled by MUNDO CROWN TOURS.

 

NISSION ISSUE AIR TICKETS

PASSPORTS, VISAS AND DOCUMENTATION

Children under 18 must have written permission signed by their parents or guardians, in anticipation that it can be requested by any authority.

 

LUGGAGE

For all purposes and in terms of land transport, it is understood that the user's luggage and other personal belongings are kept with them, regardless of the part of the vehicle in which they are placed, and that they are transported at the risk and expense of the user. . Users are advised to be present in all baggage loading and unloading operations. In terms of air, rail, maritime or fluvial baggage transport, the conditions of the carriers are applicable, with the ticket being the binding document between the aforementioned companies and the passenger. INFORMATION THAT THE DEALER AGENCY MUST FACILITATE TO THE CUSTOMER

The consumer is informed that at the time of formalization of the contract he must receive from MUNDO CROWN TOURS the pertinent information on the necessary documentation for the chosen service, as well as advice on the optional subscription of an insurance that covers the cancellation and / or of an assistance insurance that covers the repatriation expenses in case of accident, illness or death; and information on the probable risks implicit in the destination and the contracted service, in compliance with the General Law for the Defense of Consumers and Users.

 

PEOPLE WITH REDUCED MOBILITY

Persons with reduced mobility, before proceeding with the reservation request, must inform the retail agency of such situation, in order to assess the possibility and feasibility of contracting the trip according to the characteristics of the trip. CANCELLATION OF LOOSE SERVICES

ACTIONS IN CASE OF NEED

If the transfers / assistance from the airport hotel or vice versa or similar ones included in the reservation are not met, mainly for reasons beyond the control of the carrier and not attributable to the Organizer, the latter will reimburse the amount of the alternative transportation used by the client on the trip, on presentation of the corresponding receipt or invoice.

 

COMMUNICATION

Obligation of the consumer to report any breach in the execution of the service. PRESCRIPTION OF SHARES

Notwithstanding the provisions of the preceding paragraph, the statute of limitations for actions derived from the rights recognized in Book Four of Royal Legislative Decree 1/2007 shall be two years, as established therein.

 

OVERALL RESPONSIBILITY

Organizers and retailers of combined trips will respond to the consumer and user, depending on the obligations that correspond to them for their respective field of service management, the correct fulfillment of the obligations derived from the reservation made, regardless of whether these they must execute themselves or other service providers, and without prejudice to the right of clients to act against said service providers. The responsibility towards the consumer will be solidary of all entrepreneurs, whether they are organizers or retailers, jointly participate in the contract whatever their class and the relationships that exist between them, without prejudice to the right of repetition of whoever responds to the consumer and user in front of who is responsible for the breach or defective fulfillment of the reservation of the Service. MUNDO CROWN TOURS will also respond to the damages suffered by the consumer and user as a consequence of the non-execution or deficient execution of the contract. Said responsibility shall cease when any of the following circumstances occurs:

1. That the defects observed in the execution of the contract are attributable to the consumer.
2. That said defects are attributable to a third party that is not involved in the provision of the services envisaged in the contract and that are unforeseeable or insurmountable.
3. That the aforementioned defects are due to reasons of force majeure, understanding as such those circumstances unrelated to the party invoking them, abnormal and unforeseeable whose consequences could not have been avoided, despite having acted with due diligence.
4. That the defects are due to an event that the Retailer or, in his case, the Organizer, in spite of having put all the necessary diligence, could not foresee or overcome. However, in cases of exclusion of liability for any of the circumstances provided in numbers 2, 3 and 4, the organizer and its suppliers will be obliged to provide the necessary assistance to the consumer who is in difficulties.


LIMITS FOR COMPENSATION OF DAMAGE

Regarding the limit of compensation for damages resulting from non-compliance or poor execution of the included benefits, the provisions of the International Agreements on the matter will be followed.

 

RIGHT OF ADMISSION / EXPULSION

The good development of the trip is based on a normal degree of harmony in coexistence with service providers and other customers, so that the member of him who disturbs or harms such coexistence can be excluded from the group.
